User Agreement / Terms and Conditions

Wisconsin Gun Trader (wisconsinguntrader.com) / TTS, LLC

In return for using Wisconsin Gun Trader or posting content, you agree that your use and your content comply with these Terms & Conditions. We reserve the right to remove any content that violates these Terms. Content that violates these Terms may be removed immediately and without prior notice. By creating an account, posting a listing, sending a message, submitting an advertising application, or otherwise using the Site, you agree to the following:

Responsibility. I agree that I will be solely responsible for the content of all ads, listings, messages, dealer-profile information, and other materials I post or submit under this program, and that I will hold this website and TTS, LLC harmless for any losses or damages to myself or to others that may result directly or indirectly from any content I post or submit here.

By using the Site, you further agree to the following Terms & Conditions:

0. Face-to-face risk; no safety guarantee. You agree that neither wisconsinguntrader.com nor TTS, LLC nor shareholders nor officers nor owners nor associates make any guarantees or assurances regarding risks involved in face-to-face firearms transactions. We cannot guarantee your safety. You use this website and participate in any activities resulting from use of this website on your own volition and at your own personal risk.

1. Platform role (not a dealer / not a broker). Wisconsin Gun Trader provides advertising and messaging tools only. We do not sell firearms, take possession of firearms, broker transfers, run background checks, or determine buyer or seller eligibility. Sellers and buyers are solely responsible for complying with all applicable federal, state, and local laws, including confirming that any party may legally buy, sell, transfer, and possess the firearm or item, and for conducting any required transfer through a licensed dealer when the law requires it.

2. Language and conduct. No foul or otherwise inappropriate language will be tolerated. The Site may filter offensive language and strip it from posts. Attempts to bypass filters may result in immediate removal of content without warning.

3. Hate and harassment. No racist, sexist, hateful, or otherwise offensive comments, images, or attachments will be tolerated.

4. Illegal activity. No content promoting activities that would be illegal under the laws of the state or country where this Site is operated, or under the laws of the state or country where the person posting the content is located, shall be allowed.

5. Insincere / test posts. Any content that appears to be merely a test, joke, or otherwise insincere is subject to immediate removal.

6. Discretion. This website reserves the ultimate discretion as to which content, if any, violates these Terms & Conditions.

7. Age. You must be 18 years of age or older to use wisconsinguntrader.com in any way.

8. Firearms laws; hobbyist vs dealer. You must abide by local, state, and federal laws relating to selling, trading, and buying firearms and other items, especially laws related to illegal sales, illegal firearms, and when a person must be a licensed firearms dealer. Anyone who violates these Terms or applicable laws may be subject to content removal, account removal, and/or referral for possible legal action.

9. No NFA items (absolute ban). No National Firearms Act (NFA) items of any kind are allowed on Wisconsin Gun Trader, including in listings, wanted posts, messages, dealer profiles, images, titles, descriptions, and paid advertising or sponsor placements. This ban includes, without limitation: machine guns / full-auto or select-fire firearms; silencers / suppressors; short-barreled rifles (SBRs); short-barreled shotguns (SBSs); any other weapons (AOWs); destructive devices; any other item regulated under the NFA; and any item that requires an NFA tax stamp. Offering, soliciting, facilitating, or advertising NFA items is prohibited. Violations are subject to immediate content removal and account termination. There is no exception for pre-1986 machine guns, registered NFA items, dealer-to-dealer NFA marketing, or similar.

10. No destructive devices. Accounts posting or promoting destructive devices will be deleted.

11. Non-firearm items. You may post ads for non-firearm-related items only in the non-gun items section (where available), subject to these Terms and all applicable laws.

12. Emails. As a member of wisconsinguntrader.com you may receive email notifications from our systems regarding account status, messages, and member newsletters. Consider this when selecting an email address for your account. We will not sell your contact information to any third party. See our Privacy Policy.

13. Throwaway / crime-coded ads. Users who place ads for "cheap pistols," "throwaway weapons," "Saturday night specials," or similar crime-coded or reckless framing are subject to immediate account removal.

14. Help / FAQ. All posters must periodically review and abide by the guidelines on the Safety page before placing any ads.

15. Advertising and sponsors. Advertising applicants and sponsors must also comply with these Terms, including the absolute NFA ban in section 9. We may refuse, pause, or remove any advertisement or sponsor placement that violates these Terms, applicable law, or our advertising policies. Contact us for pricing. The site does not publish sponsor or founding-sponsor prices and does not take those payments. Notes kept in Admin do not create a right to advertise NFA items or other prohibited content.

16. Dealer directory. Dealer / FFL directory listings are not priced on the site. Contact us for pricing. A profile is subject to admin approval before it is public. Directory profiles must be accurate and must not advertise or solicit NFA items. Approval of a directory profile is not an endorsement of the dealer and does not make Wisconsin Gun Trader a party to any transfer.

Limitation of Liability

The information, services, and products available to you on this Site may contain errors and are subject to periods of interruption. While the Site does its best to maintain the information, services, and products it offers, it cannot be held responsible for any errors, defects, lost profits, or other consequential damages arising from the use of the Site.

IN NO EVENT SHALL THE SITE OR ITS AFFILIATES, OWNERS, AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, SPONSORS, SUPPLIERS, OR PARTNERS (COLLECTIVELY "INDEMNIFIED PARTIES") BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, SPECIAL, OR EXEMPLARY DAMAGES, OR ANY DAMAGES WHATSOEVER, ARISING FROM OR IN ANY WAY CONNECTED OR RELATING TO (i) THE USE OF (OR INABILITY TO USE), OR PERFORMANCE OF THIS SITE, (ii) ANY INFORMATION, SERVICES OR PRODUCTS PROVIDED THROUGH THIS SITE, OR (iii) ANY INTERACTION BETWEEN YOU AND OTHER PARTICIPANTS OF THE SITE, EVEN IF ANY OF THE INDEMNIFIED PARTIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACCEPT ALL RESPONSIBILITY FOR, AND HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS THE INDEMNIFIED PARTIES FROM AND AGAINST, ANY ACTIONS TAKEN BY YOU OR BY ANY PERSON AUTHORIZED TO USE YOUR ACCOUNT, INCLUDING WITHOUT LIMITATION, DISCLOSURE OF PASSWORDS TO THIRD PARTIES. BY USING THE SITE, YOU AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE INDEMNIFIED PARTIES FROM ANY AND ALL LIABILITY REGARDING YOUR USE OF THE SITE OR PARTICIPATION IN ANY SITE ACTIVITIES. IF YOU ARE DISSATISFIED WITH THE SITE, OR ANY PORTION THEREOF, OR DO NOT AGREE WITH THESE TERMS, YOUR ONLY RECOURSE AND EXCLUSIVE REMEDY SHALL BE TO STOP USING THE SITE.

Refund Policy

Paid listing extras are charged through PayPal. Wisconsinguntrader.com will not issue refunds or credits for ads or advertising that violate this agreement. Refunds or credits may be issued for paid features canceled within one hour of purchase when a paid feature exists. Any paid feature displayed or delivered for more than a one-hour period may be considered a fulfilled order. Contact contact@wisconsinguntrader.com for refund requests. PayPal's own terms also apply to the payment.

Indemnity

You agree to indemnify and hold harmless the Indemnified Parties from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, the violation of these Terms by you, or the infringement by you, or other users of the Site using your account or computer, of any intellectual property or other right of any person or entity. The Site reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Jurisdiction and Choice of Law

These Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Wisconsin, without regard to its conflict-of-law principles. You agree that any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Wisconsin, and you consent to personal jurisdiction there.

Changes

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
